  1. Condominiums:
    • You can own a condominium unit outright, provided that the foreign ownership in the building does not exceed 49% of the total floor area of all units combined. You must transfer the purchase funds from abroad in foreign currency.
  2. Leasehold:
    • Foreigners can lease land or property for up to 30 years, with an option to renew the lease for additional periods of 30 years each. This is a common way for foreigners to have long-term property rights.

You can still proceed with the purchase by following these steps:

  1. Direct Transfer from Abroad:
    • Transfer the purchase funds directly from your foreign bank account to the developer’s account in Thailand.
    • Ensure that the transfer is in foreign currency to meet the requirements for obtaining an FET form.
  2. Coordination with the Developer:
    • Work closely with your agent and the developer to ensure all necessary documents and forms, including the FET form, are correctly handled. Your agent and the developer may assist you in this process.
  3. Use of International Banking Services:
    • Some international banks with branches in Thailand may offer services to facilitate property purchases. Check if your bank has partnerships or services that can assist with the transaction.
  • Purpose: Confirms the transfer of foreign currency into Thailand for purchasing property.
  • Requirement: Needed when a foreigner buys a condominium to prove the funds originated from abroad.
  • Usage: Necessary for registering the condominium in the foreign buyer’s name and for repatriating funds if the property is sold later.

The FET form ensures compliance with Thai regulations on foreign property ownership.

  • Possibility: Yes, some Thai banks offer mortgage loans to foreigners for purchasing property.
  • Requirements: Typically, you need a valid visa, work permit, and a Thai bank account.
  • Loan Terms: Terms and conditions may vary, and the loan amount could cover up to 50-70% of the property value.
  • Documentation: Prepare documents like passport, proof of income, and property details for the loan application.

It’s advisable to check with banks directly for specific eligibility criteria and loan terms.

Many Banks in Thailand will now request a specific visa with a letter of residency in Thailand or a valid work permit to open a savings or a current bank account.

While other banks will request the original passports, an original sales agreement, and proof of a deposit to purchase a property.

You do not necessarily need a Thai bank account to buy a second-hand property in Thailand, but having one can simplify the transaction process and ensure compliance with local regulations. Here’s how it can be beneficial:

  • Benefits of Having a Thai Bank Account:
    • Simplifies the transfer of funds for deposits, payments, and expenses.
    • Facilitates compliance with regulations, including obtaining a Foreign Exchange Transaction (FET) form.
    • Preferred by some sellers or developers for transaction tracking and ease.
  • Alternatives:
    • Using a lawyer account
    • Use of international banking services that facilitate property transactions.
  • Legal Advice: Consult with a legal expert or real estate professional to ensure compliance with local laws and transaction requirements.

Having a Thai bank account can enhance convenience and compliance, but it is not mandatory for purchasing a second-hand property in Thailand.

Payment of Transfer Fee:

  1. At Land Office Transfer:
    • The transfer fee, which is typically 2% of the registered value of the property, is paid when transferring the ownership from the seller to the buyer at the Land Office.
  2. Responsibility:
    • The 2% are generally split between the buyer and seller
  3. Other Taxes and Fees:
    • Alongside the transfer fee, other costs such as stamp duty (0.5% of the registered value or sale price, whichever is higher) and income tax or specific business tax (if applicable) may also need to be paid at the Land Office during the transfer process generally by the seller.
  4. Documentation:
    • Ensure all required documents, including the sales and purchase agreement, identification, and proof of payment of taxes and fees, are prepared for the transfer at the Land Office.

Paying the transfer fee at the Land Office ensures that the property ownership transfer is legally recognized, and the buyer’s rights to the property are properly registered.
